What is Trademark?

A trademark is a unique symbol, word, phrase, logo, design, or combination of these that identifies and distinguishes the goods or services of one business from those of others. In simple terms, a trademark is what makes your brand stand out in the market. It could be your brand name, logo, tagline, or even packaging style—something that tells customers, "This product or service comes from you and not someone else."

In India, Trademark registration is a legal process through which a person or business can protect their brand name, logo, slogan, symbol, or design from being copied or misused by others. It gives exclusive ownership rights over the mark. It boosts your business credibility, protects against infringement, creates a valuable asset, and supports global brand protection. Registering a trademark in India also helps you expand internationally by securing your brand rights across borders.

Advantages of Trademark

  • a. Legal Protection: Gives you the exclusive right to use your brand name, logo, or slogan. Also, it helps us take legal action against misuse or infringement.
  • b. Builds Brand Recognition: Makes your brand easily identifiable. It helps customers associate your products or services with quality and trust.
  • c. Adds Business Value: A registered trademark becomes a valuable intangible asset. It can be sold, licensed, or franchised to generate revenue.
  • d. Prevents Unauthorized Use: Stops others from copying or using a similar mark. Protects your brand's uniqueness in the marketplace.
  • e. Helps in Business Expansion: Useful for entering into partnerships, attracting investors, or franchising. It supports business growth at national and international levels.
  • f. Global Trademark Filing Support: A registered trademark in India can help you register in other countries. Forms the basis for international trademark protection under treaties like the Madrid Protocol.

Eligibility for Trademark

  • a. Any individual, partnership firm, LLP, Trust, Society or company can apply for trademark registration.
  • b. Trademark must be unique and should not be registered already.
  • c. Trademarks must clearly reflect specific goods or services under your brand.
  • d. Trademarks should not contain marks that are misleading or deceptive.
  • e. Common or generic terms cannot be registered as trademarks.
  • f. Trademarks that are confusing or similar to existing trademarks can't be registered.

3
Examination

The application is examined for any errors or conflicts by the trademark officer. This review takes around 1–2 months.
